Defamation with False Information Leads to Prison Sentence

30s Woman Sentenced to Prison for False Rape Accusation, Legal Penalties Strengthened

A woman in her 30s who accused her biological father, who had supported her studies abroad, of being a rapist because he refused to give her money, has been sentenced to prison.

According to the legal community on the 1st, the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1 (Presiding Judge Choi Chi-bong) recently sentenced a woman in her 30s, identified as A, to 10 months in prison for charges including defamation, obstruction of business, and insult.

A was brought to trial for posting 11 times on an online community between May and June last year under the title "I am a victim of familial sexual violence. Please look at this," thereby defaming her biological father, B.

Through these posts, she falsely claimed, "I have been continuously sexually assaulted by my biological father since I was four years old, and my mother also suffered domestic and sexual violence," "The matter was settled with 30 million won in damages," and "Severe punishment is necessary."

In the process, A also exposed B's real name and business information. It is reported that B faced difficulties in operating his business as a result.


 


Additionally, A is accused of posting six times claiming that B remarried a woman, C, with whom he had been having an affair.

In February 2021, A filed a lawsuit for damages related to sexual assault against B at the Incheon District Court but failed to provide evidence of any illegal acts.

In the criminal trial, A insisted that all her writings were true, but the court did not accept her claims, citing the outcome of the lawsuit. The court pointed out that there was no specific evidence or circumstances indicating that A was habitually sexually assaulted by B.

Furthermore, the court found it reasonable to view A's claims as false, considering that she had received financial support from B during her studies abroad and after returning home, and that she filed the rape accusation shortly after demanding a large sum for running a cafe, which B refused.


The court emphasized, "She posted false information about the victims out of dissatisfaction with being denied financial support. The damaged reputations of the victims cannot be fully restored."


The court further explained the sentencing reasons, stating, "Considering the high risk of reoffending as she continues to post similar writings even after the crime, and the strong desire of the victims for severe punishment against the defendant, these factors were comprehensively considered."
